In short: Kingtide is built and operated by Kayiita Johansson, an individual based in California, USA. By signing into Kingtide, you agree to these terms and to our Privacy Policy. Kingtide is provided as is. We do our best, but you use it at your own risk and you are responsible for what's in your inbox. If something goes wrong (an important email gets archived, a triage decision misses), our liability is limited and you agree to keep us harmless.
By creating an account, signing in with Google, or otherwise using Kingtide, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
"Kingtide", "we", "us", and "our" refer to Kayiita Johansson, an individual operating the Kingtide service at trykingtide.com (Oakland, California, USA). Kingtide is not a registered corporation; it is operated as a sole-proprietor product by Kayiita Johansson. "You" and "your" refer to the person or entity using the service.
Kingtide is a tool that, with your permission, reads metadata from a Gmail inbox you connect, decides which messages are likely noise (newsletters, receipts, social pings, shipping, etc.), archives those messages, and stars messages it judges to be important. It runs once on demand for the initial cleanup and then automatically every day to keep your inbox clean.
Kingtide uses the gmail.modify Google API scope. By design, this scope cannot send email and cannot permanently delete email. Everything Kingtide moves out of your inbox stays in Gmail's "All Mail" and can be restored.
You must be at least 13 years old and have a valid Gmail account to use Kingtide. By using Kingtide you represent that you have the right to grant us access to the inboxes you connect.
You are responsible for keeping your Google account secure and for all activity under your Kingtide account. If you believe your account has been compromised, contact us right away.
Don't use Kingtide to do anything illegal, harmful, fraudulent, or that violates someone else's rights. Don't try to break, reverse-engineer, or abuse the service. We reserve the right to suspend or terminate accounts that we reasonably believe are doing any of these.
What data we collect, how we use it, and your rights are described in our Privacy Policy. The Privacy Policy is part of these Terms.
NO WARRANTY. KINGTIDE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL CORRECTLY CLASSIFY EVERY EMAIL.
In plain English: Kingtide tries hard to make the right call, but it will sometimes archive an email it shouldn't, or miss something that mattered. We give you a full audit log and a one-tap undo precisely because no automated tool is perfect. You are responsible for reviewing your inbox and the audit log.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINGTIDE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING, BUT NOT LIMITED TO, AN EMAIL BEING ARCHIVED, NOT ARCHIVED, STARRED, NOT STARRED, MISSED, OR ANY OTHER ACTION OR INACTION OF THE SERVICE WITH RESPECT TO YOUR INBOX.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE THREE MONTHS BEFORE THE CLAIM AROSE OR (B) US$50.
You agree to defend, indemnify, and hold harmless Kingtide and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the service; (b) your violation of these Terms or applicable law; (c) any content or instructions you provide to Kingtide; or (d) any consequences of an email being archived, starred, restored, or otherwise acted on by the service in your inbox.
You can stop using Kingtide at any time by disconnecting your inbox or deleting your account. We can suspend or terminate your access if we reasonably believe you've violated these Terms or put the service at risk. On termination, sections 7 through 13 of these Terms survive.
We may update these Terms. If a change is material, we'll give at least 30 days' notice (by email and/or a notice in the app). Continued use of Kingtide after the effective date is your acceptance of the change.
These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the service will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
