In short: Kingtide is a strength training app built and operated by Kayiita Johansson, an individual in California, USA. By using it you agree to these terms and to our Privacy Policy. Kingtide is not medical advice and is not a substitute for a doctor or a physical therapist. Training carries a risk of injury, and you take that risk on yourself. The app is provided as is, and our liability is limited.

1. Agreement to these terms

By downloading, opening, or using the Kingtide app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app.

"Kingtide", "we", "us", and "our" refer to Kayiita Johansson, an individual operating Kingtide from Oakland, California, USA. Kingtide is not a registered corporation; it is operated as a sole-proprietor product. "You" and "your" refer to the person using the app.

2. What Kingtide does

Kingtide builds a strength training program from what you tell it (your equipment, your available days, and the lifts you want to keep) and then reshapes that program in response to what you report: an area that hurts, a short night's sleep, a session you don't have time for. It logs the weights you lift and adjusts future sessions from that history. It can also read exercises off a photo of a plan and fold them into your program.

Everything Kingtide produces is a suggestion generated by software from the information you enter. It is not supervision, and it is not an assessment of you.

3. Health, safety, and the limits of this app

Kingtide is not a medical device and does not provide medical advice, diagnosis, or treatment. It is a fitness tool. Nothing it shows you is a clinical judgement, and it is not a substitute for a physician, physical therapist, athletic trainer, or any other qualified professional.

The app cannot examine you. When you flag an injury, Kingtide swaps or lightens exercises using general programming rules. It does not know what is actually wrong with you, has no access to your medical history, and cannot tell a strained muscle from something serious. An adaptation the app makes is not a sign that it is safe for you to train.

Talk to a qualified professional before you start, and especially before training with an injury, a medical condition, during pregnancy, or if you are returning to exercise after a long break or a medical event.

If a doctor or physical therapist has given you guidance, theirs governs, not the app's. The photo-import and PT features simply record what you enter; Kingtide does not review, verify, or approve those exercises, and does not check whether they are appropriate for you.

Stop immediately and seek medical attention if you feel pain, dizziness, shortness of breath, chest discomfort, or anything else that feels wrong. Do not train through pain because the app listed an exercise.

You assume the risk. Strength training can cause injury, including serious injury, even when performed correctly. You are responsible for your own form, your own loading, your own equipment, and your own decision to do or skip any exercise Kingtide suggests.

4. Eligibility

You must be at least 13 years old to use Kingtide. If you are under the age of majority where you live, you may only use it with the involvement of a parent or guardian who agrees to these terms on your behalf. By using Kingtide you confirm you are medically able to take part in physical exercise, or that you have been cleared to do so.

6. Subscriptions and billing

Kingtide Pro is an auto-renewing subscription sold through the Apple App Store or Google Play, depending on where you installed the app.

7. Acceptable use

Don't use Kingtide for anything illegal or harmful, and don't try to break, reverse-engineer, or tamper with the app or its subscription checks. Don't present the app's output as professional medical or fitness advice to anyone else.

8. Your data

Your training data is stored on your device, not on our servers. What does leave your device, and why, is set out in our Privacy Policy, which forms part of these Terms. You are responsible for your own copy of your data: because we do not hold it, we cannot recover it if you lose your phone, delete the app, or reset it.

9. The app is provided as is

In plain English: the app makes its best guess from what you tell it, and its best guess can be wrong for your body on a given day. Use your judgement, and a professional's, ahead of it.

12. The app stores

Kingtide is distributed through the Apple App Store and Google Play. Those stores are not parties to these Terms and are not responsible for the app. Apple and Google have no obligation to provide support for Kingtide, and any claim about the app is directed to us rather than to them. Where an app store's own terms impose additional requirements on you, those apply alongside these.

13. Termination

You can stop using Kingtide at any time by deleting the app. We may suspend or discontinue the app, or any part of it, if we reasonably need to. Sections 3, and 8 through 15, survive any termination.

14. Changes to these Terms

We may update these Terms as the app changes. If a change is material we will update the effective date above and surface it in the app before it takes effect. Continued use after that date is your acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the app will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing here removes a consumer-protection right you have under the mandatory law of the country you live in.
